TERMS & CONDITIONS
 

Applicable to all visitors, users, and members
 

1. Overview

These Terms & Conditions ("Terms") govern your access to and use of all digital platforms, services, tools, membership features, and products operated by DCS Enterprise ("DCSE"), including its three entities:

  • Sonly Consulting (SC) – Strategic Clarity, Business Architecture, Digital Products

  • Smoove Spots (SS) – Creative Lifestyle Media, Storytelling, and Digital Experiences

  • The Initiative (TI) – Public Justice Intelligence, Training Systems, Civic Empowerment

By registering, accessing, or using any DCSE platform, you agree to comply with these Terms and all applicable laws.

If you do not agree, you must not access or use any DCSE platform.

2. Purpose of DCSE Digital Services

The DCSE ecosystem provides:

  • Strategic clarity, business intelligence, and digital transformation tools (SC)

  • Creative lifestyle content, media, and structured storytelling experiences (SS)

  • Justice-aligned education, civic empowerment systems, and structured training resources (TI)

DCSE delivers digital tools, assessments, templates, videos, dashboards, AI-assisted systems, and community-based resources for adults seeking structured development.

All content is educational and developmental in nature.

3. User Eligibility

To use DCSE services, you must:

  • Be at least 18 years of age

  • Provide accurate and complete registration information

  • Use the platform for lawful purposes only

  • Refrain from exploiting, disrupting, or reverse-engineering DCSE systems

DCSE reserves the right to suspend or terminate access for any violation of these Terms.

4. License to Use

DCSE grants you a limited, non-exclusive, revocable, non-transferable license to access and use digital content and services for personal or professional development.

You may not:

  • Reproduce, resell, distribute, or publicly share DCSE materials

  • Copy, scrape, or reverse-engineer proprietary systems

  • Use content for competitive consulting, training, or rebranding

  • Share account credentials or access

All intellectual property remains the exclusive property of DCSE.

5. Intellectual Property

All products, frameworks, dashboards, assessments, AI-assisted outputs, scripts, media, templates, and branded systems are the intellectual property of DCSE and its entities.

This includes but is not limited to:

  • SC strategic systems, CTJ materials, clarity architectures

  • SS media assets, lifestyle content, GYTO™ materials

  • TI justice-intelligence frameworks and empowerment systems

Unauthorized use, redistribution, or commercial exploitation may result in legal action.

6. Digital Products & Access Terms

All DCSE products, including downloadable materials, dashboards, assessments, interactive tools, AI-assisted features, subscription content, and structured frameworks, are delivered digitally unless otherwise specified.

6.1 Access Rights

  • Access is granted upon successful payment

  • Access does not transfer ownership

  • Access may be limited to the duration specified at purchase

  • DCSE reserves the right to modify, update, or discontinue products at its discretion

6.2 Refund Policy

All digital product sales are final unless expressly stated otherwise at checkout.

6.3 License Restrictions

Products are licensed for individual use only. Products may not be:

  • Redistributed, repackaged, or sublicensed

  • Resold or used for commercial redistribution

  • Used to train competitive systems or AI models

  • Shared through unauthorized channels

6.4 AI-Generated Outputs

Where products generate automated outputs, recommendations, or structured summaries:

  • Such outputs are informational only and do not constitute professional advice

  • DCSE retains ownership of proprietary system logic and frameworks

  • Users acknowledge that outputs are generated for educational and developmental purposes

6.5 Performance Disclaimer

DCSE does not guarantee specific financial, professional, legal, or personal outcomes from use of any product. Results depend on individual effort, context, and application.

7. User Accounts & Security

Users are responsible for:

  • Maintaining the confidentiality of login credentials

  • Keeping account information current

  • Notifying DCSE of unauthorized access

DCSE is not liable for losses resulting from compromised user credentials.

8. Payments, Subscriptions & Refunds

Where applicable:

  • Pricing is displayed prior to purchase

  • Payments must be made through approved third-party processors

  • Digital content is generally non-refundable

  • Subscription plans may renew automatically unless canceled

Chargebacks or fraudulent disputes may result in account termination and recovery action where permitted by law.

9. Community Conduct

Users must interact respectfully and may not:

  • Harass or threaten others

  • Share harmful or misleading information

  • Disrupt platform functionality

  • Use TI content to provide unauthorized legal advice

DCSE reserves the right to moderate, remove, or restrict content and access.

10. Third-Party Services

DCSE may integrate third-party services for hosting, analytics, or payment processing.

Users acknowledge:

  • Third-party providers operate under their own terms

  • DCSE is not responsible for external service interruptions

11. Data Usage & Privacy

All personal data is governed by the DCSE Privacy Policy.

By using the platform, you consent to:

  • Limited processing necessary for account access

  • Platform analytics for improvement

  • Internal cross-entity data flow within DCSE governance

DCSE does not sell personal data.

12. Limitation of Liability

To the fullest extent permitted by law, DCSE is not liable for:

  • Business or financial decisions based on platform content

  • Indirect, incidental, or consequential damages

  • Platform interruptions or technical errors

  • Loss of data beyond DCSE's reasonable control

Total liability shall not exceed the amount paid for the specific product or service giving rise to the claim.

13. No Legal, Financial, or Medical Advice

DCSE does not provide licensed legal, financial, or medical advice.

All content across SC, SS, and TI is educational and developmental in nature.

Users should consult qualified professionals before making regulated decisions.

14. Termination of Access

DCSE may suspend or terminate accounts for:

  • Violations of these Terms

  • Intellectual property misuse

  • Fraudulent or abusive behavior

  • Unauthorized redistribution

Users may request account termination through formal communication.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Indiana and applicable U.S. federal law.

Disputes shall be resolved through binding arbitration unless otherwise required by law.

16. Modifications to Terms

DCSE may update these Terms at any time.

Changes take effect upon posting. Continued use of the platform constitutes acceptance of updated Terms.
